OPINION BY JUDGE DOYLE Before the Court is a petition to set aside the nomination petition of Charles Cooper, a candidate for the Democratic Nomination
for Senator in the General Assembly from the Second District (Philadelphia), by Harvey M. Rice (Petitioner) another candidate
for that office. The challenge is made under Section 977 of the Pennsylvania Election Code (Code), Act of June 3, 1927, P.L.
1333, as amended, 25 P.S. § 2937. 1 A full hearing was conducted over the course of three days, concluding at
1:00 a.m. on March 29, 1994. At the Conclusion of the hearings the parties were granted permission to file supporting memoranda
of law.
